The Federal Motor Carrier Safety Administration (FMCSA) is actively recruiting for their Deputy Chief Counsel position, ES-0905. Seeking a dynamic, energetic individual with experience with legislative and regulatory processes, for example, the development, implementation, coordination, or enforcement of statutes and regulations, especially those related to safety programs.  Seeking someone with the ability to represent and defend positions pertaining to statutes and regulations to a variety of stakeholders both inside and outside of government, in negotiation, litigation, or other settings and someone with the ability to effectively communicate advice on novel or complex legal issues to senior decision-makers.  The individual should also bring skills that have equipped them to serve as a superior executive leader.

The incumbent of this position will serve as the Deputy Chief Counsel with responsibility for furnishing legal advice and services concerning all aspects of the programs; functions, or activities assigned to FMCSA.  As a senior executive in FMCSA, the person who occupies this position will work closely with senior FMCSA management on programs and have a direct and immediate impact on FMCSA’s ability to meet its strategic goals and those of the U.S. Department of Transportation.

  • Recovery, Disposal, and/or Transportation of Dangerous Goods/Hazardous Materials (including hazardous substances and wastes, and marine pollutants)

  • Policies and Procedures Management

  • Emergency Preparedness Planning and Response (including resumption of commercial operations)

  • Consulting, Auditing, and/or Training

  • Facility and/or Vessel Safety Inspections [including, but not limited to, workplace safety (e.g. OSHA, ILO, SOLAS); pollution prevention (e.g. EPA, MARPOL); safety management programs (e.g. DOT, ISM); and security (e.g. DOT, MTSA, ISPS)]

  • Managing over 20 armored transport routes covering Miami-Dade, Broward, and Palm Beach counties (in Florida)

  • Overseeing Brinks-Miami’s branch safety improvement team (BSIT)

  • Direct liaison to all relevant governmental authorities governing safety and hazardous materials compliance, e.g. OSHA, EPA, state and local fire departments

  • Performing armored guard and route escort functions

April 2005 ~ November 2008 SEABOARD MARINE, LTD.

Company Manager of Safety/Hazardous Materials

Brought into compliance the Company’s safety training program [including their trucking (150+ drivers) and vessel (40+ vessels) fleets, and port terminal and inland warehousing operations (est. 1,000 employees)]

Developed and implemented the Company’s first Hazardous Materials Compliance and Training Plan (including the aspects of safety, emergency response, pollution prevention, security, and audits and inspections)

Project Leader and Program Manager of the Company’s intranet dangerous goods (hazardous cargo) management system, an industry-first program (co-developed with Exis Technologies, U.K.) that incorporates both the U.S. Regulations (DOT/49 CFR) and International Conventions (IMDG Code)

Direct liaison to all relevant governmental authorities, e.g. U.S. Coast Guard, U.S. Department of Transportation, port authorities, state and local police and fire departments
